Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    Expiration date: 4/10/2019

    The application is for the placement of fill material in waters of the United States, for the proposed construction of Mission Point Commercial Development, consisting of 52 acres. Approximately 1,485 linear feet of Little River, a perennial stream, would be filled/rerouted to accommodate the proposed project.

    The application is for the placement of fill material into an unnamed tributary of Mingo Creek and associated on channel pond to construct a commercial and industrial development and road access, two reinforced concrete boxes, and a new spillway for the existing pond.

    The application is to reroute approximately 700 linear feet of an unnamed tributary of Boomer Creek resulting in the placement of 0.27 acres of fill.

    On February 14, 2019, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) published for public comment a proposed rule revising the definition of “waters of the United States,” which would establish the scope of federal regulatory authority under the Clean Water Act (CWA).

    The application (ODOT Job Piece (JP) 25444(04)) is for the placement of fill material to construct a new road with bridge abutments, riprap, and concrete piers for a new bridge, reinforced concrete box (RCB), and using the placement of fill (earthen material) for a temporary work road and temporary cofferdam.
