Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

SWT-2015-319 - 11/18/2015: The application is for the placement of 3.35 acres of fill into waters of the United States associated with the construction of a shipping facility, including access drives, employee and fleet parking lots, detention basin, sanitary sewer utility, and perimeter drainage swales.

SWT-2014-303 - 11/9/2015: The application is for the conversion of two on-channel ponds, one wetland, and portions of a stream channel into residential subdivision housing units, access roads, and installation of public utilities.

Terra Foundation ILF Stream & Wetland Mitigation Program for use within the State of Oklahoma - 10/23/2015: On September 25, 2015, the Corps of Engineers approved the Terra Foundation ILF Stream & Wetland Mitigation Program for use within the State of Oklahoma. The ILF will be available in the following HUC watersheds (Service Areas): 11090202 (Canadian B), 1109203 (Canadian C), 11100302 (Beaver/North Canadian D), 11100303 (Beaver North Canadian E), 11110101 (Lower Arkansas), and 11110102 (Lower Arkansas B). SWT-2015-437 - 10/19/2015: The application is to accommodate the expansion of the existing East Oak Recycling and Disposal Facility and the existing Mosley Road Landfill in order to ultimately combine the two into one consolidated unit operating under one ODEQ permit.

Flood Recovery and Repair Activities in the Tulsa District - 8/28/2015: Tulsa District has anticipated that municipalities and owners of damaged property will want to conduct repair activities in the near future. A U.S. Army Corps of Engineers (USACE) Section 404 Clean Water Act permit may be required for dredging or placing fill in waters of the United States, including rivers, lakes, streams, creeks, and wetlands.
