Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    The application is for the discharge of dredged material into Lake Wichita, Holliday Creek, and Pecan Creek associated to the dredging/excavation of Lake Wichita. The application is also for the placement of fill material in Lake Wichita for 22 major components relating to existing residential/commercial facilities. The proposed components are four new boat ramps (with associated bank stabilization), two kayak launch access areas, a seawall, mooring trail/stations, fish jetties, boardwalks, circle trails, beach trails, and two swim beach areas.

    The application is for the placement of 1.19 acres of fill into waters of the United States associated with the construction of a commercial and residential development, including access drives, parking areas, and public recreation areas.

    Expiration date: 12/5/2016

    The application is for the placement of fill material within an unnamed tributary to the North Canadian River and an associated wetland to expand the Oklahoma City Landfill to the north of the existing facility. Purpose: The basic purpose of this work is to provide a long-term solid waste landfill. A solid waste landfill is not a water dependent activity. The proposed project would result in the placement of fill material in a special aquatic site. The overall purpose of the project is to provide a long-term solid waste disposal facility for the City of Oklahoma City and surrounding areas. The applicant’s proposed project would provide approximately 23 acres of expansion to the existing Oklahoma City Landfill.

    The application is for the placement of fill material related to the proposed replacement of two bridges on unnamed creeks , associated with the widening of State Highway (SH) 16 in Wagoner County. The basic purpose of the proposed work (State Job Piece 24366(04)) is to replace and widen two structurally deficient Reinforced Concrete Box (RCB) bridges for public safety .

    The application is for the placement of fill material related to the proposed replacement of the Kiamichi River Bridge, overflow bridge, and widening of US 271 in Pushmataha County.
