Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

The U.S. Army Corps of Engineers (USACE) and the U.S. Environmental Protection Agency (EPA) jointly announce the availability of the Interim Draft of the National Ordinary High Water Mark Field Delineation Manual for Rivers and Streams (National OHWM Manual) and are soliciting public comments on this Interim Draft.

    The proposed project would construct a rock dike along the left descending bank of the Arkansas River within the U.S. Army Corps of Engineers (USACE) Kaw Lake Civil Works Project. The existing concrete boat ramp replacement was verified under Nationwide permit. The bank stabilization areas 1 through 7 do not require Section 404 authorization, because the 24-inch quarry run stone rock would be placed above the ordinary high water mark of the Arkansas River.

    The application proposes a 73.2 acre lateral expansion of the existing landfill to the north. The proposed project also includes the construction of landfill waste disposal cells and a stormwater pond within scrub-shrub wetlands, open water, an intermittent stream, and an ephemeral stream.

    Expiration date: 10/28/2022

    The County of Reno, Kansas, proposes to realign and replace the bridge connecting Willowbrook Drive to North Wilson Road. The proposed alteration is confined to the existing levee right-of-way of the Hutchinson Local Flood Protection Project Levee F. The proposed bridge will be located approximately 142-feet north of the existing bridge and existing bridge abutment will be realigned to pick up the proposed bridge. The existing bridge will remain open during construction of the new bridge. After construction of the new bridge is complete, the existing bridge and abutments will be removed.
