Proposed Lower Bois d'Arc Creek Reservoir, Environmental Impact Statement (EIS)

BACKGROUND:

The North Texas Municipal Water District (NTMWD) submitted an application June 4, 2008, to the USACE to discharge dredged and fill material into Bois d' Arc Creek in Fannin County, Texas for the construction of a dam to impound the flow of the creek to provide a new water supply reservoir. At the designed conservation pool of 534.0 ft msl, the lake would comprise 16,641 surface acres. This reservoir would provide water to numerous towns, cities, and utility districts in portions of Collin, Dallas, Denton, Fannin, Hunt, Kaufman, Rains and Rockwall Counties in north central Texas. At conservation pool the proposed reservoir will store 367,609 acre-feet and provide a firm yield of 126,200 acre-feet per year.

Bois d'Arc Creek is considered waters of the United States (U.S. ), and the construction of a dam is an activity which requires authorization from the USACE subject to Section 404 of the Clean Water Act. Evaluation of the Section 404 permit application is a federal action subject to review under the National Environmental Policy Act of 1969 (NEPA). The USACE, Tulsa District has determined that the proposed project will require an Environmental Impact Statement (EIS) prior to the final decision on the permit application. The EIS is being prepared by a Third-Party Contractor, Mangi Environmental Group, at the direction of the USACE.
