Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

The proposed project plan involves a horizontal directional drill (HDD) installation of a 6-inch high-density polyethylene (HDPE) pipeline to support an upcoming Environmental Protection Agency (EPA) Groundwater Recovery and Treatment Project located near West 57th Street North and North Broadway. The proposed HDD entry and exit locations are each situated at least 300 feet from the levee centerline on both sides of the channel, meeting the USACE minimum setback requirement. Additionally, the depth of the bore satisfies the requirement of being equal to or greater than two times the levee height beneath the levee foundation. The proposed 6-inch high-density polyethylene (HDPE) pipeline installation shall be designed and constructed in strict accordance with ER 1110-2-1913, Design and Construction of Levees, and ER 1110-2-2908, Conduits, Pipes, and Culverts Associated with Dams and Levee Systems. The 6-inch HDPE pipeline will be installed via horizontal directional drilling (HDD) beneath the WVC Little Ark River Levee M and the WVC Chisholm Levee S. The submitted boring pressure calculations were reviewed and found to be within permissible limits. The HDD alignment beneath the channel maintains a minimum horizontal distance of 300 feet from the centerline of each levee, in compliance with USACE requirements. Upon completion of construction, the contractor shall restore all disturbed areas by seeding and watering until a fully established sod cover is achieved in accordance with project specifications.
