Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

  • OSMM Field Trial

    Expiration date: 7/31/2022

    This Special Public Notice announces the Field Trial Period for the OSMM is nearing completion. The OSMM is applied on those permit evaluations where a pre-construction notification or individual permit application is required to be submitted to the Corps. The OSMM is authorized for use by the Corps, applicants, and authorized agents to determine the amount of compensatory mitigation necessary to offset unavoidable stream impacts associated with Department of the Army permit evaluations (see 33 CFR 332.3(f)). All users have the ability to provide substantiated comment concerning this OSMM during the Field Trial Period.

    Expiration date: 6/6/2022

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, the Public Service Company of Oklahoma (PSO) (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to install an overhead fiber optic line crossing the Verdigris River.

    The proposed Quail Creek Drainage Improvements Project consists of five components: Quail Creek channel, Kemp Boulevard to Maplewood Avenue culvert, Midwestern Parkway culvert enhancement, North Quail Creek channel, and Gladney channel. A project location map is provided in Figure 1. A plan view and cross section exhibit depicting the proposed improvements is provided in Figure 2. A waterbody impacts map is provided in Figure 3.

    PUBLIC INVOLVEMENT: The purpose of this notice is to solicit comments from the public; federal, state, and local agencies and officials; tribes; and other interested parties regarding the Case Park Roadway. Comments received within 15 days of publication of this notice will be used in the evaluation of potential impacts of the proposed action on important resources and in the evaluation of whether the proposed alteration would be injurious to the public interest and/or would impair the usefulness of the authorized project. Only the specific activities that have the potential to occupy, use, or alter Tulsa – West Tulsa Local Flood Protection Project Levee A will be evaluated. Please limit comments to the area of the alteration and those adjacent areas that would be directly or indirectly affected by the requesters proposed project.

Please limit comments to the area of the alteration and those adjacent areas that would be directly or indirectly affected by the requesters proposed project.
