Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    Expiration date: 5/19/2024

    This proposed bank protection project (ODOT Job Piece 34260(04)) is designed to eliminate a large scour hole within Beaver Creek that is threatening the US-70 bridge. The application is for the construction of two Turf Reinforcement Mats (TRM) with appurtenant features and rock riprap to provide a resilient channel with restored stream function to reduce erosion and instability. Soil fill material consisting of unclassified borrow topsoil would also be used for grade sloping and bedding for the TRM. The proposed improvements to Beaver Creek (scour hole) would consist of three primary components for restoration of stream channel and bed: 1) Rock Riprap, 2) TRM, and 3) Installation of Sheet Pile Structures and Cap (SPSC).

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, Phillips 66 Carrier, LLC (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) for the replacement of pipeline PP-05 under the North Canadian Channel in Oklahoma City, OK.

    The application is for the discharge of fill material consisting of graded limestone rock into and adjacent to 2,810 linear feet of a tributary of Covington Creek (to stabilize the bank). The proposed project will also include the construction of a temporary access/low water crossing (16 linear feet) for a construction road.

    Expiration date: 4/28/2024

    Project Description: The application is for the rehabilitation of the Upper Black Bear Creek No. 62 (Lake Perry) reservoir to address flood safety criteria and performance standards for high hazard potential class (c) dams as defined by the NRCS and state of Oklahoma. The dam was recently elevated from significant hazard class (b) to high hazard class (c) due to increased development and roadways downstream which would be inundated by a catastrophic dam failure event. The proposal includes the rehabilitation of the principal and auxiliary spillway structures, maintenance to the existing riprap covering the earthen dam, as well as other elements which do not require a Section 404 Permit. As a result of this work, the current normal operational elevation (conservation pool) of the lake would be raised by approximately 2.1 feet to accommodate additional water supply storage for the City of Perry.

  • OSMM public notice

    Interested parties are hereby notified that the District Engineer (DE) has updated the Oklahoma Stream Mitigation Method (OSMM) tool. The OSMM establishes a stream credits system by quantifying unavoidable impacts to streams associated with proposed projects submitted for authorization under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.
