The shoreline use permit moratorium in effect at Eufaula Lake only applies to review and approval of new permit applications.

The lake manager can still permit the replacement of an existing dock.

There are numerous developers who have constructed community docks as part of their housing additions. Within these areas, availability of these docks is unaffected by the moratorium. In addition, the ability to transfer ownership of existing docks, whether private or community is unaffected.

Prior to the moratorium, the lake manager has approved 42 permits for boat dock construction and an additional eight permits are still being processed. Construction activity on all approved structures is not precluded by the moratorium.

The Corps of Engineers is in the process of preparing an Environmental Impact Statement as part of the shoreline management and master plan updates. During this process, baseline environmental conditions must remain the same in order to gain an accurate snap shot of environmental conditions at the lake. Therefore the moratorium is needed. The moratorium will expedite the Environmental Impact Statement process in accordance with the National Environmental Policy Act.
