Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    The applicant proposes the rehabilitation of IH 35 to correct design deficiencies and provide frontage roads throughout the project limits. This is expected to improve public safety, transportation mobility, add capacity, and enhance economic development opportunities for existing and future travelers in the region.

    The application is for the discharge of fill material into Jap Beaver Lake. The activity includes spillway structure replacement, boat ramp maintenance, construction of approximately six, 100 foot long jetties, and approximately 5,000 feet of bank stabilization.

    On August 21, 2020, the Corps of Engineers approved the Honey Springs Mitigation Bank for use within the State of Oklahoma. The Primary Service Areas for the Honey Springs MB will be available in the following HUC watersheds: 1110101 (Polecat-Snake) and 11110102 (Dirty-Greenleaf); the Secondary Service Areas for the Honey Springs MB will be available in the following HUC watersheds: 11070105 (Lower Verdigris Watershed), 11070107 (Bird Watershed), and the portion of 11070106 (Caney Watershed) south of Hwy. 60.

    The overall purpose of this work is for the proposed pipeline installation within multiple WOUS, at single and complete project locations, associated with the supply of up to 160,000 barrels per day of crude oil from tankage located in Cushing, Oklahoma to the two refinery facilities located in Tulsa, Oklahoma. The project is not a water dependent activity.
