Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

  • SWT-2015-775

    Expiration date: 5/17/2016

    The application is for the placement of 65,610 cubic yards (cys) of fill material associated with the construction of South Tulsa/Jenks Low Water Dam (LWD) project and appurtenant features into the Arkansas River to facilitate a new static pool and pedestrian bridge. The proposal would also result in the construction of 7 public access features and 8 site-specific shoreline stabilization projects.

  • Terra Foundation ILF Stream & Wetland Mitigation Program for use within the State of Oklahoma

    On September 25, 2015, the Corps of Engineers approved the Terra Foundation ILF Stream & Wetland Mitigation Program for use within the State of Oklahoma. The ILF will be available in the following HUC watersheds (Service Areas): 11090202 (Canadian B), 1109203 (Canadian C), 11100302 (Beaver/North Canadian D), 11100303 (Beaver North Canadian E), 11110101 (Lower Arkansas), and 11110102 (Lower Arkansas B).   • Flood Recovery and Repair Activities in the Tulsa District

    Expiration date: 10/31/2015

    Tulsa District has anticipated that municipalities and owners of damaged property will want to conduct repair activities in the near future. A U.S. Army Corps of Engineers (USACE) Section 404 Clean Water Act permit may be required for dredging or placing fill in waters of the United States, including rivers, lakes, streams, creeks, and wetlands.

    Expiration date: 7/1/2015

    Pursuant to the Final Rule for the Compensatory Mitigation for Losses of Aquatic Resources, referred to as the Mitigation Rule (33 CFR Parts 325 and 332, and 40 CFR Part 230), dated April 10, 2008; this notice announces a prospectus submitted for the establishment of a Mitigation Bank (MB) within the State of Oklahoma. The primary purpose of this MB is to mitigate for unavoidable impacts to streams and wetlands authorized under Section 404 of the Clean Water Act. The project goal is to restore stream and wetland functions and values within the mitigation bank area.

  • SWT-0-14659, Lower Bois d'Arc Creek Reservoir (LBCR) Draft Environmental Impact Statement

    Expiration date: 4/21/2015

    This public notice for notice of availability for a Draft EIS pursuant to the National Environmental Policy Act (NEPA) of 1969, to analyze the direct, indirect, and cumulative effects associated with the proposal. The purpose of LBCR is to provide the NTMWD with approximately 126,200 acre-feet/year (AFY) of new reliable municipal water supply annually, which will meet a portion of the applicant’s reasonably projected future additional water supply needs. Up to 175,000 AFY of water would be diverted from the LBCR, with an estimated firm yield of 126,200 AFY, and transported for treatment at the new WTP and eventual delivery to member cities and direct customers in NTMWDs service area, which includes all or portions of Collin, Dallas, Denton, Fannin, Hopkins, Hunt, Kaufman, Rains, and Rockwall Counties in northern Texas. This project is one among several large projects that NTMWD would have to construct and bring online over the coming decades to meet projected population growth and increasing water demand within its service area northeast of Dallas, Texas.
