Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    Expiration date: 3/22/2019

    The application is to reroute approximately 700 linear feet of an unnamed tributary of Boomer Creek resulting in the placement of 0.27 acres of fill.

    Expiration date: 4/15/2019

    On February 14, 2019, the U.S. Environmental Protection Agency (EPA) and the Department of the Army (Army) published for public comment a proposed rule revising the definition of “waters of the United States,” which would establish the scope of federal regulatory authority under the Clean Water Act (CWA).

    Expiration date: 3/5/2019

    The application (ODOT Job Piece (JP) 25444(04)) is for the placement of fill material to construct a new road with bridge abutments, riprap, and concrete piers for a new bridge, reinforced concrete box (RCB), and using the placement of fill (earthen material) for a temporary work road and temporary cofferdam.

    Expiration date: 3/2/2019

    The application is to construct several bridges, culverts, reinforced concrete boxes (RCB), and stream realignment to facilitate the new Gilcrease Expressway. This includes constructing a span bridge over the Arkansas River, a span bridge over Berryhill Creek, and impacts to several other waterways.

    Expiration date: 1/17/2019

    The overall purpose of this work is to expand the existing Choctaw Nation resort. The proposed expansion would construct new and additional hotel rooms, swim areas, conference spaces, a ballroom, a fitness center, along with garage and surface parking, while remaining on trust lands in the current service area of Durant, Oklahoma.
