Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    Expiration date: 11/21/2014

    The application is for the expansion of the left descending bank into the Arkansas River to accommodate the construction of two land bridges over Riverside Drive and to provide riverfront recreational opportunities for the proposed park. The proposed public recreation park is known as “A Gathering Place” for Tulsa. The support features include long-term bank stability, ADA compliant pedestrian access to the river, access to the existing River Parks trail system, lake viewing lawn, nature walk, skateboard park, and would provide safe public access across Riverside Drive.

    PUBLIC NOTICE CLEAN WATER ACT PROPOSED RULE FOR DEFINITION OF WATERS OF THE U.S. Comment Period Extension for the Clean Water Act Proposed Rule for Definition of Waters of the U.S. On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act. This notice is to announce that the comment period has been extended through November 14, 2014. The comment period has been extended in response to stakeholder requests and to allow comments on new supporting materials. The agencies expect to receive additional relevant materials from the Science Advisory Board prior to October 20, 2014, which will be placed on the docket as soon as they are available. We encourage interested parties to periodically check the docket for updates on these materials. The comment period which was originally scheduled to end on July 21, 2014, had been previously extended to October 20, 2014. Comments now must be received on or before November 14, 2014.

    The basic purpose of this project is to construct a mixed use development site, which includes a multi-unit independent senior residential and assisted living complex and a commercial/office/retail center. The overall project purpose is to fulfill the need for new multi-family residential areas in a growing sector and for complimentary mixed use office-commercial space.

    Expiration date: 9/24/2014

    The application is to protect State Highway (SH) 10 from Illinois River erosion by restoring the right descending bank, adjacent riparian area, and river equilibrium. The overall purpose of the proposed work is restoration of the riverbank and riparian corridor, and restoration of stable river channel and river habitat, for the purpose of protecting SH 10 from continued erosion. Discharge includes excavation and grading of the riverbed, restoration of the riverbank; and placement of rock vanes within the river for stream enhancement, and erosion control.
