Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    Project Description: The application is for the discharge of dredged or fill material consisting of 50 cubic yards (cys) of clay and 12-inch to 18-inch rock riprap into the North Canadian River for the bank stabilization of approximately 1,250 linear feet (lf) of eroded riverbank where the left descending bank of the North Canadian River has migrated northeast.

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, the City of Wichita (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) for the placement of a 54-inch pipe and 230-foot concrete outfall structure over WVC Big Slough Levee C North.

    REQUESTER: In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, Century Link Communications, LLC (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to install three 1.25-inch HDPE and four 2-inch HDPE conduits up and over the WVC Big Slough Levee D all in parallel to each other.

    Work authorized by the proposed GP would be limited to discharges of dredge or fill material into waters of the United States for activities required for the construction, expansion, modification, or improvement of bridge replacement projects (e.g., roads, highways, railways) in waters of the United States, including adjacent wetlands. Bridges authorized by this GP would be subject to the requirements of the enclosed GP 17.
