Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

SWT-2017-507 - 2/20/2018: The application is for the placement of fill material related to the proposed construction of six bendway weirs and a directional spur upstream of the existing US 62 bridge over the North Canadian River. Severe recent erosion is threatening the bridge. The current course of the channel has severe erosion occurring on the northeast banks extending east (downstream) towards US 62 while developing a depositional sandbar to the southwest.

SWT-2014-675 - 1/19/2018: The application is for the placement of fill material related to the proposed repair of the Interstate 44 (I-44) Bridge over the Deep Fork River.

SWT-2016-637 - 11/28/2017: The application is to construct a stormwater detention facility, which includes an earthen berm along the south and west side of the facility with a concrete discharge structure at the southwest corner to control water discharges.

SWT-0-14659 - 11/3/2017: Notice of application for a Department of the Army permit under Section 404 of the Clean Water Act; Notice of Availability of a Final Environmental Impact Statement (FEIS) for the proposed Lower Bois d’Arc Creek Reservoir (LBCR) project, Fannin County, Texas. The U.S. Army Corps of Engineers, Tulsa District, is evaluating a permit application for the construction of a 10,400-foot long earthen dam that is expected to inundate 16,641 acres along Bois d’Arc Creek. This notice is to inform interested parties of the publishing of the FEIS.

Proposal for a New Regional Condition to Nationwide Permit 12 for the State of Texas - 7/28/2017: A proposed regional condition to NWP 12 for just the Fort Worth District was initially published for comment as regional condition 11. It was withdrawn. After additional evaluation, the Division Engineer modified his decision and proposes a statewide regional condition requiring notification to the Corps prior to construction of new water intake structures that include discharges of fill into waters of the United States.
