Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

    The purpose of this work is to construct a road within the Hulah Wildlife Management Area (WMA) to facilitate public access to Federal Lands.

    The Corps proposes to discharge dredged material into waters of the United States associated with the routine maintenance dredging of the McClellan-Kerr Arkansas River Navigation System in an area adjacent to the navigation channel between RM 373.5 and 375.5 when upland disposal is not practicable in order to adequately maintain channel depths for navigation during periods of low flow.

    The Corps proposes to discharge dredged material into waters of the United States associated with the routine maintenance dredging of the McClellan-Kerr Arkansas River Navigation System in an area adjacent to the navigation channel between RM 346.4 and 348.9 when upland disposal is not practicable in order to adequately maintain channel depths for navigation during periods of low flow.

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, the City of Oklahoma City, OK (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to perform relocation of soil berms to facilitate the construction of trail ramps leading to the lower trails adjacent to the Oklahoma River, North Canadian Channel.

Title 33, Chapter 9, Subchapter 1, Section 408, the Public Service Company (PSO) a subsidiary of American Electric Power (AEP) (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to rebuild the existing Riverside to S. Hudson 138kV transmission line as part of a system reliability project.
