Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

  • Section 408 Special Emergency Processing Procedures for Activities Subject to EO14156

    The purpose of this notice is to advise the public that the United States Army Corps of Engineers may employ emergency procedures to process requests to alter a Corps Civil Works project under 33 USC §408 (Section 408) if the request is associated with an activity that facilitates the identification, leasing, siting, production, transportation, refining, and generation of domestic energy sources as directed in Executive Order 14156.

    The purpose of this public notice is to announce the establishment of the special emergency processing procedures for activities subject to Executive Order 14156 National Energy Emergency and provide information to the public about those special emergency processing procedures.

Title 33, Chapter 9, Subchapter 1, Section 408, the Kansas Department of Transportation (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) for the construction of new bridge abutments downslope of existing bridge abutments on the embankment of the Larned Kansas Levee.

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, the Black Hills Energy (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to replace approximately 550 linear of existing natural gas pipe with a proposed 8-inch steel gas main constructed using horizontal directional bore under Hutchinson Levee A & D.

    The overall purpose of this project is to bring Fourche Maline Creek Watershed MPS No. 7M into compliance with current NRCS and Oklahoma safety performance standards for a high hazard dam and extend the service life to 100 years, reducing the risk of catastrophic dam failure and loss of life.
