Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

  • Special Public Notice for Oklahoma

    Expiration date: 4/30/2022

    This public notice is to announce and convey the 2021 Oklahoma Regional Conditions and Oklahoma Clean Water Act (CWA) Section 401 Water Quality Certifications. These documents and certifications will go into effect for the subject 41 nationwide permits (NWPs) on February 25, 2022 and are attached to this public notice. The Corps is not seeking comments at this time.

    Expiration date: 3/4/2022

    The purpose of this notice is to solicit comments from the public; federal, state, and local agencies and officials; tribes; and other interested parties regarding the construction and installation of a 8-inch steel pipeline under WVC Big Slough Levee C North, WVC Big Slough Levee D and MS Mitch Mitchell Floodway. Comments received within 10 days of publication of this notice will be used in the evaluation of potential impacts of the proposed action on important resources and in the evaluation of whether the proposed alteration would be injurious to the public interest and/or would impair the usefulness of the authorized project. Only the specific activities that have the potential to occupy, use, or alter WVC Big Slough Levee C North, WVC Big Slough Levee D and MS Mitch Mitchell Floodway will be evaluated. Please limit comments to the area of the alteration and those adjacent areas that would be directly or indirectly affected by proposed highway interchange expansion.

    Expiration date: 3/3/2022

    The application is for the placement of dredged or fill material to construct a new road with bridge abutments, riprap, and concrete piers for a new bridge. Since the original authorization of this project, no changes have been made to the design and no relevant changes in the site conditions have occurred. Hence, the comment period on this public notice is reduced to 15-day.

    Expiration date: 3/19/2022

    The application is for the discharge of dredged or fill material into Lake Hefner for shoreline repair and bank stabilization of approximately 1,400 linear feet (lf) of eroded bank on the east side of Lake Hefner.

    PUBLIC INVOLVEMENT: The purpose of this notice is to solicit comments from the public; federal, state, and local agencies and officials; tribes; and other interested parties regarding the proposed Reinforced concrete 12-inch pipe, headwall, and flap gate, Sand Creek channel embankment project. Comments received within 10 days of publication of this notice will be used in the evaluation of potential impacts of the proposed action on important resources and in the evaluation of whether the proposed alteration would be injurious to the public interest and/or would impair the usefulness of the authorized project. Only the specific activities that have the potential to occupy, use, or alter Sand Creek channel embankment and Newton Channel will be evaluated. Please limit comments to the area of the alteration and those adjacent areas that would be directly or indirectly affected by proposed highway interchange expansion.
