Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest in relation to Section 10 and Section 404.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

  • 2026 SWT District NWP Reissuance Final Action

    On January 8, 2026, the U.S. Army Corps of Engineers (Corps) published a final action in the Federal Register (91 FR 768) announcing the reissuance of 56 existing nationwide permits (NWPs) and one new NWP, as well as the reissuance of NWP general conditions and definitions with some modifications. These 57 NWPs will go into effect on March 15, 2026, and will expire on March 15, 2031. One NWP was not reissued.

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, Kansas Department of Transportation for the City of Wichita, KS (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to reconstruct a Highway K-15 bridge over Chisholm Creek located in Wichita, KS.

    To construct a Flood Equalization Basin (FEB) associated with the existing wastewater treatment plant for the City of Okmulgee.

    Expiration date: 1/14/2026

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, Professional Engineering Consultants (PEC) for the City of Derby, KS (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to install a 16-inch waterline over the Wichita Big Slough Levee C South, Wichita Levee D - Big Slough, and WVC Riverside Levee R.

    In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408 Kansas Department of Transportation (KDOT) and with concurrence of the levee sponsor, which is the City of Wichita, Kansas (requester) has requested permission from the U.S. Army Corps of Engineers (USACE) to replace the existing 5-span Continuous Welded Plate Girder with two 4-span Prestressed Concrete Beam Bridges over the Wichita Flood Control Channel, known as M.S. Mitch Mitchell Floodway.
